These terms and conditions apply only to IMMAYA V.O.F offers, quotes, and agreements. Other terms and conditions are definitively rejected. Deviations or additions to these terms and conditions are valid only if they have been explicitly accepted in writing by IMMAYA V.O.F.
By placing an order, buyer accepts the applicability of the terms and conditions. Acceptance of the terms and conditions is part of the order. Orders can be made online at www.underun.nl, by mail, or by telephone. The terms and conditions are made available to the buyer each time prior to the conclusion of the agreement. For online orders, the buyer must accept the terms and conditions. The terms and conditions can be consulted and downloaded for future reference. For telephone orders and orders by e-mail, IMMAYA V.O.F. will refer to the applicable terms and conditions through correspondence, whereby the buyer gives permission for the digital reception of the terms and conditions which can be consulted and downloaded through the link provided. The agreement based on the order will only come into effect after confirmation by IMMAYA V.O.F.
Right of withdrawal for consumer who purchases remotely
In the case of an agreement due to a remote purchase and where the buyer qualifies as a consumer, that buyer has the opportunity to dissolve the agreement without giving a reason for 14 days. This notice will commence on the day after receipt of the product by the buyer or a third party designated by the buyer. During this period of time, the buyer will carefully handle the product and the packaging. The buyer will not unpack or use the product. If the product is unpacked or used, there will be a possibility of revocation in connection with the status of the product. The buyer can use the form located at https://www.acm.nl/en/onderwerpen/sales/consumentregels/modelstructures-for-uitoefening-van-de-bedenktijd/ or by written statement addressed to IMMAYA V.O.F. The revocation must reach IMMAYA V.O.F. within the appropriate period of time. The buyer must return the product with all accessories that were delivered and in its original condition and return within 14 days after revocation, following instructions given by IMMAYA V.O.F. Shipping costs are the responsibility of the buyer. The purchase price will be refunded by IMMAYA V.O.F. within 14 days of receipt of the product unless it appears that the product has been unpacked and/or used and is no longer useful because of hygiene risks. In regards to the right of withdrawal, legal exclusions apply further.
An exchange is only possible if the request is made within 14 days of receipt by the buyer. The buyer may make a request for exchanges during that period and IMMAYA V.O.F will consider such a request. The product is not eligible for exchange if the product is damaged, used, removed from the packaging and/or its item card has been removed. The buyer must also be able to deliver the purchase price. The buyer will send the product to IMMAYA V.O.F., which will then be promptly be reviewed to determine if the item is eligible for exchange. If so, the replacement product will be sent to the buyer within 30 days.
Shipping costs for return shipping are the responsibility of the customer. The shipping fee for the new item (on exchange) will be covered by IMMAYA V.O.F.
It will only be delivered after receipt of full payment. Most of the goods that are available are in stock. The stated delivery terms should only be used as an indicator and are non-binding. A delay in delivery does not give the buyer the right to compensation or to the dissolution of the agreement. Nor does the buyer have the right to suspend his obligation to IMMAYA V.O.F. in that case.
In the case of force majeure, IMMAYA V.O.F. is authorized to cancel the closed agreement without judicial intervention or to suspend delivery until the time when the force majeure has ceased to exist without the buyer being entitled to damages. Upon delivery, the buyer will receive an invoice.
The prices listed on the website are also guaranteed in the case of force majeure. Prices are in Euro and include VAT, delivery costs are not included unless stated otherwise.
All liability of IMMAYA V.O.F. and IMMAYA V.O.F. personnel and products for all damages, of any kind, directly or indirectly, including company damage, consequential damages, property damage or property, are expressly excluded. IMMAYA V.O.F. shall not be liable for any damage caused by third parties upon execution of the agreement. Unless and in so far as there may be intentional or gross negligence on the part of IMMAYA V.O.F.
IMMAYA V.O.F. is not liable for any damages arising from the use of the products which have been sold. The buyer uses the product at their own risk. IMMAYA VOF is not responsible for any improper use by the buyer or by users of its products.
Any liability of IMMAYA V.O.F. against purchaser shall in any case be limited to the purchase price that the buyer has fulfilled under the agreement for the relevant damaging product and, to the extent that such limitation does not prevail, the limitation of liability is linked to the paid invoice amount of the relevant agreement with IMMAYA V.O.F.
For misunderstandings, mutilations, delays or improper delivery of orders and communications resulting from the use of the Internet or any other means of communication between the buyer and IMMAYA V.O.F., or between IMMAYA VOF and third parties, in so far as they relate to the relationship between customer and IMMAYA V.O.F., IMMAYA V.O.F. is not liable unless and in so far as there may be intentional or gross negligence by IMMAYA V.O.F.
Complaints relating to non-conformity of deliveries, damages and visible defects must be communicated by the buyer to IMMAYA VOF within 48 hours of delivery to the buyer. This complaint must be communicated in writing, accompanied by photographs as evidence. Not communicating the complaint correctly and in a timely manner will result in a delayed response.
Complaints due to hidden defects or non-compliance must be made in writing within 14 days of receipt of the goods, at least within 7 days after discovery. In the absence of this, the complaint will not be processed due to the automatic expiry of the right.
The lodging of a complaint does not relieve the buyer of his payment obligations.
Returns may only be made if there is a written agreement from IMMAYA V.O.F.
The personal information provided by the buyer while making an order with IMMAYA V.O.F. is automatically saved to a customer file. This information may be used by Underun.nl to provide information to the buyer and to follow the orders. The buyer can request this information and also request for adjustment and removal. The data will not be made available to third parties.
